All owners or managers of land from which trees grow, have a Duty of Care to take reasonable steps to avoid foreseeable acts or omissions which may result in damage or harm to others. This Duty of Care is conveyed upon owners and managers of land by the Owners and Occupiers Liability Act 1957/84.

Areas of public access land have an obvious need for professional tree inspections. Even trees on private land with no public access should be inspected where trees have a potential to affect others, for example, where trees near boundaries could fall into the highway or neighbouring land.

A number of accidents resulting from tree failures in recent years have highlighted the need to ensure that managers of trees have reasonable systems in place for tree surveying and inspection.

To dispense this Duty of Care, owners and managers of land with trees present must demonstrate a proactive approach to tree inspections and the management of tree associated hazards.

Hazard management plans

We will devise a defensible hazard management strategy for any number of trees from one to thousands. Broadly a defensible strategy must address the following four requirements; a pro-active approach, prioritised, actioned and recorded.

We will employ a range of tree inspection methodology available to us, to ensure tree hazard management is effective in any given situation. The level of inspection can be increased where necessary to include various techniques of diagnostic investigation; this is normally reserved for situations where either the risk level (associated with the site and its usage) or value of the subject tree requires it.

Reports on protected trees

Our reports may be submitted as part of an application for carrying out work to trees protected by a Tree Preservation Order, Conservation Area restrictions or covered by Planning Conditions.

A number of accidents resulting from tree failures in recent year’s has highlighted the need to ensure that managers of large tree stocks have reasonable systems in place for tree surveying and inspection.
